How the contract is formed between us

After you place an order, you will receive a confirmation email from us acknowledging that we have received your order and that payment for your order has been approved. A contract between you and us will only be formed upon receipt of payment for the product(s) ordered. In the case of commissioned jewellery or jewellery made from heirloom precious metals and/or gemstones, a contract will only be formed upon receipt of either a monetary deposit or a deposit formed of your own precious metals and/or gemstones.

Price & Payment

The price of products will be as stated on our website, inclusive of 20% VAT. Product prices and delivery charges are liable to change at any time, but changes will not affect orders that have already been processed and a confirmation email received.

You can pay for Products using a debit or credit card via the checkout option on our website. The payment will be taken through PayPal Website Payments Pro. If you do not want to pay using PayPal Website Payments Pro, you can pay for your Product by bank transfer. To do so please fill out the Contact Form on the contacts page and ask for the relevant details.

UK & International Delivery

Justin Duance offers free delivery worldwide for standard orders. All pieces are sent via special delivery with the Royal Mail and will need to be signed for. All our jewellery is hand made to order and we aim to make and deliver your item within 3-6 weeks from the order date.

For orders dispatched to UK addresses, all pieces are sent via Special Delivery with the Royal Mail and will need to be signed for. They should arrive the following working day after being sent, and you will be emailed an email with a tracking number when they’re in the post.

We use a courier service for international orders. Delivery times vary depending for different countries. 

Justin Duance Jewellery will usually only deliver parcels to the purchasing credit/debit card holder’s address and on delivery the parcel will require a signature. We will not be held responsible for the parcel if it is signed for by anyone other than the card holder.

We shall be under no liability for any delay in delivery or non-delivery due to circumstances beyond our control.

If the parcel/product is lost or found to be damaged upon receipt, then Royal Mail and Justin Duance must be informed without delay and any damaged item(s) returned to us for replacement.

Express Delivery

We can occasionally make pieces more quickly on request, however this is highly dependent on material availability and is not possible during busy periods. When available, our express fee is £25-£100 per piece.

If you would like this service, please get in touch with us first to check we can make the item in time. To put your order under an express delivery option, you can email us via the Contact Form, but we advise calling us on 01736 367254 to get straight through. During quieter times we will use our own discretion regarding express charges for orders as we will always send our items as soon as they are ready.

Cancellation & Returns

In most cases, if you are unsure of your purchase we are happy to send you a sample ring and sizers so you’re able to check the dimensions and size needed before we go ahead and make the item. We prefer to work with you to ensure that the ring will be suitable and therefore not returned. We reserve the right to exclude items from the thirty-day refund policy and will always contact you prior to their manufacture if this is the case. Refunds will be made by the original method of payment.

Because all our rings and pieces are handmade to the size ordered, we cannot offer exchanges for different ring sizes. We will also not provide a refund if it is evident that more than one ring was purchased with the express intention of choosing between them and returning one for a refund.  Because all our rings are handmade to the size you order, you cannot swap a sized ring for a different size without paying the resize charge.

If you are dissatisfied with your purchase, you may return it to us in its original unworn condition (trying for size accepted) within thirty days immediately after the signed receipt date. When we have received the item(s) we will offer you a full refund. If you’re worried about the style we can send you a sample version first. Postage costs will only be refunded if there is a fault with the item. For hygienic and health and safety reasons all earring studs will not be accepted for return.

Refunds may not be authorised for bespoke items and rings received back more than thirty days after dispatch. When we do accept these items back, they will usually be subject to administration or restocking charges.

Resize

We can resize most of our rings at a charge of £50.

Titanium can be resized but usually only within 1-2 sizes up or down – if needed we can make a replacement ring at a reduced price.

Warranty

Although unlikely, should an item fail to correspond with specification or show a defect in material or workmanship we will gladly exchange or refund on return of the faulty product(s) within twelve months from delivery. Justin Duance will use its own discretion in replacing these damaged goods and we will not credit or replace items that have been ill-treated or suffered damage through normal wear and tear or where an attempt to repair has been made by any third party.

Guarantees

Silver Guarantee

For silver pieces, we provide a two-year guarantee as silver is naturally a softer precious metal and not as durable as other metals.

This also applies to silver wood inlay rings; if there are any problems with the wooden inlay within the two-year period, we will repair it free of charge along with a basic restoration of the piece while we repair the wood. This is excepting cases where the piece has been damaged due to damage or excessive wear (for example, misshaping of the metal).

After the two-year guarantee period is over, we will charge a small fee to refurbish, repair and restore pieces if possible. This also covers a new piece of wood being inlaid if necessary, and the restoration of the piece as well as the costs of the postage in its return.

If the item is too worn to be reliably repaired, we’ll charge 50% of the current retail price of the piece to replace it.

In this case, we’ll also contact you to offer a discounted price to remake the piece in a more durable metal, such as titanium. Prices in precious metals are offered on request as they are subject to the type of design and fluctuation of prices in the metal market.

We do not advise choosing silver rings if they’re to be used as wedding rings due to the softness of the metal and the ease with which it can be damaged in everyday use. This refers to wooden inlay rings in particular.

Other Metals Guarantee

If there are any issues with items within the first five years of ownership (excluding external damage/excessive wear), we’ll be happy to repair the item for you free of charge. After the five-year period is up, there will be a small fee for any refurbishment or repair. This excludes silver jewellery.

Other repairs

For replacing things like cord/clasps, there’s a charge of £20. This includes restoration of the piece and a care pack. For replacing chains where necessary, we charge the cost price of the chain and postage.

Third party rights

This contract is between you and us. No other person shall have any rights to enforce any of its terms.

Law, Jurisdiction and Language

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

Changes to these Terms

We reserve the right to change these Terms and Conditions from time to time. Please review our Terms and Conditions regularly to ensure you are aware of any changes we have made.
